Introduction
These Terms & Conditions (hereby referred to as "Terms") serve to govern the use and access of our dashboard and correspondence with our subcontracted social media account managers (hereby referred to as "Services"). Please go through these Terms carefully and thank you for looking into our Terms, as they are important to understand!
Terms are Legally Binding
By using the Services we provide, you agree to be legally bound by the Terms outlined on our website as well as comply to the Privacy Policy also defined on our website.
When we use the words "Trending Realtor," "we,", "our," or "us" throughout this policy, we're referring to Trending Realtor Inc., which is understood as the intermediary company that connects "Account Managers" to provide the Customer with Services listed on our website. When we talk about "Services" in this policy, we are referring explicitly to the actions committed by Account Managers in order to help you grow your social media accounts.
You are an Authorized Member of Our Community And Your Account is Managed
A company, organization, or other qualified third party we refer to in these Terms are considered the "Customer". Being a Customer effectively makes you a member of our Community. Every member of our Community is provided a communication channel to an "Account Manager", which in and beyond these Terms is understood as a third-party, subcontracted person(s) that provides Services of Trending Realtor on behalf of the Customer. An Account Manager is granted access to the social media account(s) of the Customer, thus allowing for the fulfillment of Services.
For you, this means:
Your Customer Data is accessed discreetly both by employees of Trending Realtor and by third party, sub-contracted account managers in order for improved delivery of Services. You agree to allow access to Customer Data upon registering for access to our Services under a "Contract", which is activated upon Customer Registration. This Contract holds our commitment in delivering Services to the Customer through the delegation of tasks to a subcontracted Account Manager.
Notable Rules
The Services provided by Trending Realtor require for the Customer to follow the Rules specified below as well as comply to the Privacy Policy described.
The Customer Must Be Aged 18 or Over
Services we provide are strictly unavailable to children under the age of 18. If a child under the age of 18 has provided us with their information without a consenting parent/guardian, please contact us immediately.
The Customer Is Bound to Contract Periods
These Terms remain in effect until the end of the Customer's billing cycle. The Customer is entitled to cancel their contract with us without prior notice or given reason. The Customer is required to cancel their billing at least ONE (1) day prior to the following billing cycle. Otherwise, the Customer is obliged to fulfill the last month of billing prior to cancellation. Please note that pausing an account does not cancel the subscription and related charges.

All cancellations must be submitted via email to support@waltoe.com no later than 7 DAYS BEFORE YOUR NEXT BILLING DATE.
The Customer Agrees To Limitation of Liability
Services provided by Account Managers of Trending Realtor will not be held accountable to the Company, Trending Realtor Inc. The Company may not be held liable for any potential damages incurred. We may directly step in and take what we deem appropriate action against the Customer or Account Manager (including the disabling of accounts on the Trending Realtor website) depending on circumstance. In no event will you or us have any liability to the other for lost profit, revenue, or any circumstantial, incidental, consequential, punitive, or other forms of damages however they may have been caused, whether in contract, tort, or under any other theoretical circumstance of liability and regardless of whether the party has been advised of the possibility of the aforementioned damages. You will have no financial liability to us for a breach of these Terms, and our maximum aggregate liability to you for any alleged breach of these Terms.
The Customer Agrees Services May Be Delayed Or Suspended Under Force Majeure
While Trending Realtor strives to provide the very best Account Managers to fulfill services to the Customer, unforeseeable circumstances may prevent our Account Managers from fulfilling their contractual obligations. Otherwise known as "Superior Force," a "Force Majeure" is understood as natural disasters, including fire, flood, earthquakes, storms, hurricanes, other natural disasters, war, invasion, acts of hostility, civil war, rebellions, revolutions, insurrections, military coups, terrorist activity, suspension of electricity or phone services. No party is considered liable under said events. Should the Service to the Customer be postponed, suspended, or cancelled under Force Majeure, both the Customer and the Company agree not to hold any party liable.

BECAUSE OF THE SENSITIVE AND PROPRIETARY NATURE OF OUR INTELLECTUAL PROPERTY AND SUPPORT, COACHING, AND SAAS SERVICES, FACEBOOK AD LEAD GENERATION CUSTOMERS SUBSCRIPTION FEES AND SET-UP FEES ARE NONREFUNDABLE. CUSTOMERS WILL NOT QUALIFY FOR ANY REFUNDS, CANCELLATION OR DEFERRED PAYMENTS. UPON THE RARE CASE CUSTOMERS MAY WANT TO STOP ANY SERVICE THEY CAN DIRECTLY CANCEL FROM CUSTOMERS LOGIN ACCOUNT ON OUR WEBSITE. WWW.TRENDINGONMEDIA.COM.
Pre-paid plan and all subscription monthly fees and set-up fees are nonrefundable.
Refunds for annual subscriptions are provided at the sole discretion of the Company. Refunds are not provided for annual subscriptions if the Service is provided as stated. Fulfillment of Service results in cases of non-refund. Should a refund for an annual subscription be provided at the discretion of the Company, the Company may offer only partial refund in accordance to the remaining time on the Subscription minus discount offered on the price.
Refunds When Account Paused
As stated in the Helpdesk FAQ and Terms of Service, pausing an account does not cancel the subscription and related charges. The pause functionality serves to let your account manager know he should temporarily stop activity on your account. It does not pause the subscription itself, meaning it does not affect time until the subscription is renewed or the billing date. We don’t currently credit additional days for paused days. If you believe you should be refunded for a paused account please contact Support, refunds will be reviewed on a case by case basis.
Discrepancies & Agreement to Terms
The Terms stated above, including any terminology referred to in our Terms or within our Privacy Policy, are constitutive of the entirety of our Terms agreement between you the Customer, us the Company, and involved third parties that provide Services, wholesomely understood as the Account Managers. The Terms stated supersede prior agreements (both written and verbal) concerning all subject matter related to the provision of Services and Terms of use of Trending Realtor as an intermediary Service. Should there be conflict, inconsistency, or claims that counter either the Terms or Privacy Policy, the terms stated on this Terms page shall be the prevailing agreement presented to any "Authoritative Party" understood as local jurisdictive parties.
Governing Law
The Terms stated above and any disputes relevant to the Terms or our Privacy Policy shall be addressed exclusively by the law of Canada and relevant constitutional bodies of Canada.

This Billing Policy is incorporated into the WALTOE, (“waltoe.com”) BOSS Terms of Service (https:/waltoe.com/boss-terms-conditions) and sets forth the billing terms and conditions that apply to your access and use of WALTOE’s services (the “Services”). In the event that the Terms of Service and this Billing Policy conflict, the Terms of Service control.
General. Upon signing, dating, and returning your Marketing Agreement, the Services will commence and all corresponding payments, as set forth in the Marketing Agreement, will be due and owing, these payments are due every 30 days and until your “term” is finished. All prices are payable in USD, and all payments are non-refundable under the circumstances that all agreed upon guarantees are met.
Payment Methods. All payments must be made using a valid credit or debit card issued by American Express, MasterCard, Discover or Visa, which must be kept on file with your Account (your “Payment Methods”). Checks, cash, and electronic funds transfer are not accepted methods of payment. You are required to keep your Payment Method details and contact information current, which you can do by logging into your Account, clicking on Settings, and then clicking on Payment Settings. By providing your Payment Method to WALTOE, you certify that you are an authorized user of the card.
Billing Cycle. You authorize WALTOE to bill your Payment Method in advance on a periodic basis for the amounts set forth in your Marketing Agreement, and you agree to pay any charges so incurred, until the end of the Subscription Plan term set forth in your Marketing Agreement (the “Subscription Term”). Billing periods typically begin on the day of the month in which your Account was activated (“Billing Date”). Payment Methods are automatically charged at the beginning of each billing period on the Billing Date. Invoices and payment receipts are available upon request by contacting the WALTOE Billing Department at support@waltoe.com.
Failure to make full and complete payment by the Billing Date may result in fees, charges, and assessments, as set forth in Section 6 (Fees) below. If you fail to make payment on your Billing Date, or if your Payment Method is declined, your access to your Account will be temporarily suspended until your balance is paid in full. WALTOE will attempt to charge the Payment Method on file for 60 calendar days. If your Account remains delinquent for 60 calendar days, the Account will be cancelled and turned over to a third-party collection service. You will not be able to recover any files until the Account is reinstated by paying off any remaining balances.Advertising Budget. By subscribing to WALTOE advertising services, you understand and agree that you are required to pay a monthly amount (the “Ad Budget”) to be used by WALTOE to contract with certain third party providers to place internet advertising on your behalf to generate leads. You understand and agree that your Ad Budget will be automatically charged to your Payment Method at the beginning of each billing period on the Billing Date and does not replace, reduce or otherwise impact any other charges listed in your Subscription Agreement. You may not lower your ad budget below the agreed upon fees at any time. You may not attempt to cancel or pause your ad budget while your Account is active.
Cancellation. At the end of the Subscription Term, your Account will automatically convert to a month-to-month plan at then-current pricing, unless you a) sign a new Subscription Agreement, or b) send written notice of cancellation to support@waltoe.com no less than 10 days prior to the end of the Subscription Term and receive an email response acknowledging your cancellation request. In the event your Account converts to a month-to-month plan, you may cancel at any time by sending written notice of cancellation to support@waltoe.com, in which case, your Account will be closed on the last day of the billing period in which you submitted the cancellation request.
If you cancel your Account prior to the end of the Subscription Term, or if we cancel your Account due to a violation of the Terms of Service, this Billing Policy, or the Privacy Policy, no refunds will be issued, all outstanding payments will remain due, and we will continue charging the monthly payments to your Payment Method for the remainder of the Subscription Term. Alternatively, you may pay an early cancellation fee, plus any outstanding payments, in a lump sum payment due immediately, in which case, your Account will be closed on the last day of the billing period in which the early cancellation fee was paid. If you do not finish your Subscription Term, you will NOT under any circumstances be subject to your guarantee refund. All outstanding payments must be paid in full upon cancellation of an Account. All cancelled Accounts with an outstanding balance may be automatically turned over to a third-party collection service, subject to the fees, charges, and assessments set forth in Section 6 (Fees) below. Data will be stored for no longer than 90 days post cancellation.Fees. WALTOE does not anticipate that you will fail to pay for the Services on a timely basis, and we do not extend credit to our customers. In the event you fail to make full and complete payment by the Billing Date, you may be subject to the following fees, charges and assessments:
* Any payments that are past due will incur an interest charge at a rate equal to the lesser of (i) 1.5% per month or (ii) the maximum interest rate allowed by applicable law.
* Any payments that are 10 days or more past due will incur an interest charge at a rate equal to the lesser of (i) 10% per month or (ii) the maximum amount allowed by applicable law.
* In the event WALTOE receives a chargeback from a credit card company or bank on your behalf, WALTOE may assess you a $50.00 processing fee for each individual chargeback.
* In the event WALTOE uses a third-party collection service or attorney to collect money owed to us by you, WALTOE may assess you a $15.00 processing fee, and you will be charged all reasonable costs and fees associated with such a collection, including, but not limited to, any third-party collection service’s fees, reasonable attorneys’ fees, and arbitration or court costs.Any fees, charges, or assessments resulting from late payment or nonpayment will be considered liquidated damages intended to be a reasonable advance estimate of our costs resulting from such late payment or nonpayment. These costs will be difficult to calculate or to predict when we set such fees, charges and assessments, because we cannot know in advance whether you will pay for the Services on a timely basis, if ever, and what costs we will incur as a result of your late payment or nonpayment.
Billing Disputes. To dispute any charge related to the Services, you must contact WALTOE in writing at support@waltoe.com, or submit a ticket from your Account, within 30 days after the disputed charge is first incurred. You agree to refrain from disputing the charge with your credit card company or bank for 30 days after reporting the dispute to WALTOE, to allow WALTOE the opportunity to resolve the dispute. Should WALTOE receive a chargeback from a credit card company or bank on your behalf before WALTOE has been given 30 days to resolve the issue, WALTOE has the right to collect on the rendered services and any payments associated with the dispute.
In the event WALTOE receives a chargeback from a credit card company or bank on your behalf, WALTOE will immediately suspend the Account pending the outcome of the dispute. Regardless of the outcome of the chargeback,WALTOE retains the right to collect on any rendered services or payments outstanding, and the Account may be turned over to a third-party collection service.Guarantees. We offer clients a 100 leads and 15-20 appointments guarantee over the course of the client’s first 90 day Subscription Term with us. This guarantee is only eligible if the client FINISHES the 90 day term. If the client attempts to cancel the agreement before the end of term, no refunds will be rendered and client will still be liable for any and all payments due to WALTOE as stated in section 5. If the guarantee is not met, the client will receive a prorated refund based on the number of appointments that were rendered.
Example: $4500 fee over 90 days, 15 minimum guaranteed appointments = $300 per appointment. If a client receives 10 appointments, they will be subject to a refund of $1500. 5 appointments x $300 per appointment = $1500 prorated refund. In order to receive this refund, requests must be made in writing to support@waltoe.com.

To improve our Services. We look into how our customers navigate across our dashboard portal in order to inform our account managers, allowing them to provide better more accurate Services to the Trending Realtor user.
To maintain better support. When contacted with a problem, Trending Realtor uses the information a customer has provided to respond.
Billing purposes. When account data provides billing information, Trending Realtor uses this to accurately account for billing and payments.

Transfer their Data: Users have the right to receive their Data in a structured, commonly used and machine readable format and, if technically feasible, to have it transmitted to another controller without any hindrance. The Right to Object to Processing
Where Personal Data is processed for a public interest, in the exercise of an official authority vested in the Data Controller or for the purposes of the legitimate interests pursued by the Data Controller, Users may object to such processing by providing a ground related to their particular situation to justify the objection.
Users must know that, however, should their Personal Data be processed for direct marketing purposes, they can object to that processing at any time without providing any justification. Exercising Rights
Any requests to exercise User rights can be directed to the Data Controller through the contact details provided in this document. These requests can be exercised free of charge and will be addressed by the Data Controller as early as possible and always within one month.
Defining Broader Protection Standards Applicability
Most provisions of this document concern all Users. Some provisions expressly only apply if the processing of Personal Data is subject to broader protection standards.
Such broader protection standards apply when the processing:
is performed by an Data Controller based within the EU;
concerns the Personal Data of Users who are in the EU and is related to the offering of paid or unpaid goods or services, to such Users;
